• Use of the Software and License

    License of VQSCollabo

    　Please read the following carefully before using this software (program)(hereafter called Contracted Software).You are requested to accept the following items regarding the software(program) contract between you and Osamu Envivion Technology Inc.(hereafter called Osamu)

    1. Contract term

    This contract starts valid from your purchasing date.

    This contract is valid until it is ended. Osamu can terminate the royalty of the contracted software without announcement always, when you break one provision of these contracts.

    You have to cancel and eliminate the computer program which came to hand from Osamu within 30 days, and all duplicate things from the day which the royalty ended based on the above.

    2. The range of a royalty

    By this contract, you can use the computer program of the contracted software only by one computer.

    You cannot use the computer program of the contracted software at two or more terminals called at a network. Except when only a part is reproduced for the defrosting for backup possession of the contracted software, you cannot create the duplicate of the contracted software.

    You cannot change the computer program of the contracted software, or cannot analyze by the method of disassemble and others.

    You cannot add change to a display of the rightful claimant of the copyright currently displayed on the contracted software, and others.

    You must not reveal the secret of Osamu which could be known by use of the contracted software to other third persons.

    3. The right of the contracted software

    　All the rights of the copyright of the contracted software, ownership, and others belong to Osamu except for the thing clearly given to you in this contract, and the specified thing.

    4. The range of a guarantee

    The contracted software is offered in the present condition, and Osamu begins the goods nature and the conformity to a specific use about the contracted software, and, clearly, it does not offer any guarantees in tacit.

    The problem generated about the contracted software shall be solved　by responsibility and expense burden of you.

    5. Osamu's responsibility

    　Osamu does not bear any responsibility to direct or indirect damages caused. Furthermore, for damages beyond the company has promised to bear, Osamu sticks to the aforementioned statement even if it was aware of the possibility of damages. Moreover, it will not be responsible for any complaints made by the third parties.

    6. High-risk tasks

    　This product is not a damage tolerance program. The program is not intended, constructed, or produced to be sold again to be operated as a part of automatic control system which its damage may give physical (even life), material, or environmental harm in a dangerous environment.

    7. Export

    　The product is included as a strategic material under the Foreign Exchange and the Foreign Exchange Control Act. To export the program outside Japan, procedure based on the foreign exchange control act and other pertaining regulations is needed.

    8. Competency Court

    　Kyoto District Court will be the competent court if one is having a lawsuit regarding the contract.

    9. Entire Agreement Clause

    　This contract includes all the agreements with you and the company, which will be applied in priority before the previous ones (be it verbal or written).

    The Camellia technology which is code algorithm is used for this product, and the mounting is made from Osamu. Camellia is the algorithm which NTT and Mitsubishi Electric developed, and are the Europe recommendation code and an electronic government recommendation code.

    The portion about the coding technology of the portion of TwinVQ technology contained in the contracted software belongs to Nippon Telegraph and Telephone Co. (it is called Following NTT). As for these, Osamu has received the license from NTT. Reproducing and reproducing these right things without notice is forbidden law.
